    Bryan Kohberger is asking an Idaho court to withdraw his guilty plea in the murders of Kaylee Goncalves, Madison Mogen, Xana Kernodle, and Ethan Chapin. He says his lawyers coerced him. He says the confession was false. He says evidence was hidden.
    But the question nobody seems to be asking is: what happens if he wins?
    If a court withdraws the plea, the deal that kept Kohberger off death row ceases to exist. Idaho maintains the death penalty and authorizes execution by firing squad. Attorney General RaĂºl Labrador has already signaled the state is prepared. The Goncalves family has said publicly they are ready for trial and confident in a death sentence. Latah County Prosecutor Bill Thompson — who cut the original deal over the families' objections — would face the prospect of re-prosecuting a case the defendant already confessed to.
    Kohberger signed a nine-page plea questionnaire confirming his plea was voluntary. He told Judge Hippler under oath he was guilty. He answered yes to every safeguard question. Idaho's post-sentencing standard for withdrawal is manifest injustice — one of the highest bars in American criminal law.

    Bryan Kohberger Handed His Only Hope To Someone Else

    Bryan Kohberger's petition to withdraw his guilty plea in the University of Idaho murders is very likely going nowhere, and understanding why means starting in 1967.
    That is the year Idaho added section 19-4901 to its books. It is the Uniform Post-Conviction Procedure Act, and it guarantees a convicted person the right to come back at a conviction one more time in a separate civil case, with new evidence, at public expense.
    It was sitting right there the entire time prosecutors were explaining to four grieving families what a plea agreement would mean.
    This episode covers why in detail. The manifest injustice standard. The sworn colloquy where he told the court he was guilty. The two different pieces of hair evidence being reported as one. And the single narrow path to a new trial, which depends entirely on what his former attorney is willing to swear to.
    But there is a larger question underneath the filing, and it isn't about him.
    The families of Kaylee Goncalves, Madison Mogen, Xana Kernodle and Ethan Chapin gave up a trial. No jury. No witnesses. No state made to prove a single element out loud in front of the world. They surrendered all of it in exchange for one thing, and that one thing was finality.
    Nobody involved in that negotiation had the standing to promise it. Not the prosecutor. Not the judge. Not the document all of them signed. 
    Tony also covers the detail that reframes the plea itself: prosecutors filed a witness list naming a hundred and eighty people who could help convict him, and newly unsealed records show a name on it that no one expected. Days later, he stopped fighting — and now offers the very same people as proof he was forced.
